Drunk in Public

Drunk in public is a crime that is often used as a catch all for the police. You are drunk in public if you are intoxicated by legal or illegal drugs that produce intoxication as well as the use of alcohol. There is no specific evidence that the police collect for this offense. Generally they do not perform breath tests or field sobriety tests as would be the case with DUI/DWI cases. Generally the smell of alcohol and/or any loss of bodily function or control however slight will be grounds for arrest.

Domestic Assault

Domestic Assault is a charge that is handled by the Juvenile and Domestic Relations Court. It is a class one misdemeanor with maximum penalties of one (1) year in jail and a $2500 fine. In addition the police will issue a Temporary Protective Order requiring you to have no contact with the household or family member alleging the assault. This Order may be extended or become permanent depending on the situation and the determination of the Judge.

Computer Crimes

There are a number of specific computer crimes, both misdemeanor and felony. Commonly, misdemeanor offenses include advertising, distributing, displaying or otherwise soliciting child pornography as well as soliciting a child for sexual activities. This is by no means a full list of computer related crimes. The misdemeanor penalty for these crimes is a class one misdemeanor punishable by one (1) year in jail and up to a $2500 fine.

Assault & Battery

Assault is a class one misdemeanor with up to one (1) year in jail and up to a $2500 fine. In addition there may be additional costs for restitution of medical bills and other costs associated with the offense. In addition to these penalties there may be civil consequences that could be affected by a criminal conviction.
